Upon purchase, the risk of the object of sale shall transfer to the successful bidder.
In the event of a dispute, regardless of the reason or cause, the bidder agrees that the court with jurisdiction over the seller's current address shall be the exclusive court of first instance, and that legal action will be initiated in said court. This exclusive jurisdiction agreement shall apply even to matters outside the scope of this transaction.
If litigation is to be heard in a court other than the one with jurisdiction over the seller's current address, the successful bidder shall be obligated to withdraw the lawsuit and waive the rights pertaining to the subject matter of said lawsuit.
The seller may cancel the transaction at any time for reasons attributable to the seller, without the buyer's consent.
Cancellations may be made by the seller without prior notice and regardless of whether the buyer is at fault.
In the event of a dispute arising from this transaction, the maximum amount of damages the successful bidder can claim, whether for breach of contract or tort, shall be limited to the total of the winning bid amount and shipping costs.
The successful bidder shall bear the costs of restoration to the original condition due to cancellation, and any other related fees.
If the seller's responsibility is to be pursued, the successful bidder shall bear the burden of proof for any claim and must provide evidence that leaves no room for reasonable doubt.
The successful bidder shall bear all responsibility for any and all issues inherent in transactions between parties, regardless of where responsibility lies.
If any monetary transactions such as refunds become necessary due to any circumstances arising from this agreement, such transactions shall be conducted between Japan Post Bank accounts, regardless of our fault.
If, for any reason, the successful bidder needs to ship an item to the seller, the seller shall choose the shipping method, regardless of whether the seller is at fault for the circumstances that necessitate the shipment.
If, for any reason, the successful bidder needs to ship an item to the seller, and the seller is at fault for the circumstances that necessitate the shipment, the seller shall be deemed to have fulfilled their obligation by paying only the shipping costs. The seller shall not incur any claims from the successful bidder for any other actions necessary for the shipment, such as packing and shipping, by the successful bidder related to said shipment. #きーろ
